This legislation would reclassify mastectomy bras as medical devices, rather than regular apparel, in the tariff code—a much more accurate description of the use of these products—amending the United States tariff schedule to establish proper tariff classifications for silicone breast prosthetics and mastectomy bras.
The Need for Reclassification
Breast cancer is the most commonly diagnosed cancer in women, with two million new cases worldwide each year. 70% of patients have breast-conserving surgery during the course of their treatment. For some breast cancer patients and survivors, particularly those who have endured high levels of radiation, reconstructive surgery is not medically recommended or possible.
Mastectomy bras are engineered to hold and support prosthetic breast forms, which aid in recovery, balance, and spinal alignment while mitigating the risk of long-term chronic pain.
